Terms and Conditions Creastairs

The following activities are included in the agreed price:

  1. Masking and covering of floors, walls and elements around the stairs. We use special tape for masking walls that does not leave any residue. This tape is also suitable for sensitive surfaces. Think of wallpaper or a freshly painted wall. Using sealant against the part to be treated, we ensure that the base layer does not have a chance to get through. We do everything we can to deliver the best possible result, but are not responsible for damage to walls, floors and other elements.

  2. The parts to be treated are placed in a color primer, which is injected with pigment particles.

  3. This is then sealed with a 1k coating
    Finally, the stairs are finished with a super matt 2k coating. This gives the whole a natural look.

  4. The masking tape is gently removed.

  5. everything is neatly vacuumed.


If stated otherwise on the quotation, the following activities are not included in the price:

  1. Remove old stair covering.

  2. Sand or remove adhesive residue

  3. if old glue residues are present, the stairs must be painted with a stain coating. This is because we do not know what kind of glue is on it and it can penetrate our material.

  4. If there is paint on the stairs, it must be sanded

  5. If necessary, seal gaps between stairs and riser with special sealant that can be painted over. This is necessary for new-build stairs, in connection with the finishing of the stairs.

  6. Fill holes. The front step remains as it is, otherwise it becomes a weak link.

  7. if there are cracks/sealant edges on the side of the stairs, we will place a finishing slat here to finish it off.

 

Costs of additional work.
Please pass on the necessary additional work in advance, in connection with the planning of the work.

Creastairs cannot reasonably be bound by obvious mistakes and/or writing errors in offers, quotations and agreements.

 

Working hours

  1. Our working hours are from 7.30 am to 5 pm.

  2. We plan your work so that there is room for extension, due to drying times that are difficult to predict.

  3. In the evening you can use your stairs again after 20:00. 

 

Schedule

  1. If you agree with the price, Creastairs will make a final quote/order stating the date of the work.

  2. By agreeing to this final quote within 2 days, the order becomes binding and we schedule it. We also state a delivery time. We order the materials for you.

  3. If it proves impossible to carry out the work on the planned date due to delivery problems or any other cause, the work will be postponed. The postponement period is a maximum of one month and never longer than the original delivery time. Any price increases within this period will not be passed on.

  4. If the postponement period or the agreed delivery time is exceeded, the customer may dissolve the agreement without notice of default or judicial intervention and/or request compensation.

  5. If the presumed or agreed delivery time is exceeded, the entrepreneur is not liable for any form of consequential damage in the case of an agreement with a business customer.

 

Payment

  1. Payment is made for 100% at the start of the work. This also applies to the necessary additional work that is not stated in the quotation.

  2. If you are unable to attend on the day of the appointment, please notify us 7 days in advance. Can't we go and have you not reported this? Then we are forced to charge € 280.

 

Price increases
For price increases at consumers, occurring after the conclusion of the agreement but before delivery, the following applies:

  • Price increases due to VAT increases and other legal measures can always be passed on.

  • Other price increases within 3 months after concluding the agreement may not be passed on.

  • Other price increases after 3 months after concluding the agreement may only be passed on if this has been agreed. The entrepreneur will state why a price increase can be implemented and whether or not the consumer can dissolve the contract free of charge afterwards.

 

Spaces where work needs to be done

  1. The customer ensures that the stairs and the space around the stairs are clear. Think of removing shoes, coats, coat racks and wall decoration.

  2. Electricity and water must be available.

  3. The temperature in the room may be a minimum of 18 degrees and a maximum of 25 degrees Celsius.

  4. Please keep pets in other areas. This is to prevent hairs or prints from getting into the work.

 

Cancellation

  1. If the customer cancels, he will owe compensation. This is based on lost income by the entrepreneur. The compensation is made up of the gross profit margin (fixed and variable costs, profit mark-up), less variable costs not incurred, such as delivery costs. The compensation amounts to 30% of the purchase/contract price.

  2. When purchasing, a consumer can cancel in writing within 2 days, starting the day after the sale was concluded, at a fixed percentage of 5% of the purchase price with a minimum of € 500.

  3. Unfeasible agreement due to force majeure:

  4. If fulfillment of the agreement is temporarily impossible due to a cause that cannot be attributed to one of the parties, the other party will be released from its obligations for that period.

  5. In the event that compliance with the agreement is wholly or partly permanently impossible for one of the parties due to a cause that cannot be attributed to it, both parties will make every reasonable effort to still perform the agreement. The parties will discuss this. If the parties cannot reach an agreement, they have the right to dissolve the agreement in whole or in part, respectively, against payment to the other party of the costs reasonably incurred and to be incurred.

 

Conformity and warranty

  1. The warranty period is 10 years.

  2. The delivered product must have those properties that the consumer may expect under the agreement under normal use (conformity).

  3. The customer must at all times observe the instructions for use as provided by Creastairs. This implies:
    After delivery it takes another 7 days before the coating is at full strength. You should take this into account.
    Clean with Creastairs maintenance product.
    Avoid sand or other substances that can act as an abrasive on the stairs.
    Do not walk the stairs in coarse-soled shoes.

  4. Excluded from the guarantee are mechanical damage and external influences.

  5. If errors, defects or imperfections with regard to those products are the result of incorrect or careless use of the products by the customer, or repair work by third parties, this may mean that Creastairs does not have to proceed with (free of charge) repair and/or or any warranty given by Creastairs will lapse.

  6. Guarantee on material for the first 2 years 100%, then a depreciation of 12.5% per year.

  7. Complaints

  8. If the customer has a complaint about the products and/or services of Creastairs, the customer must report this fully and clearly (preferably in writing or by e-mail) to Creastairs.

  9. All complaints must be reported to Creastairs as soon as possible, but no later than 2 weeks after the discovery thereof, or the moment at which the complaints could reasonably have been discovered. Failing this, Creastairs can attach the consequences to which it is entitled by law, such as the lapse of the right to (free of charge) repair or replacement.

  10. After a complaint has been reported, the customer must give Creastairs the opportunity to investigate the complaint and the customer is obliged to give Creastairs the opportunity to repair any defects.

  11. This also applies to special use in the event that the parties have agreed upon the conclusion of the agreement.

  12. If this expectation is not met, the consumer is entitled to repair or replacement, dissolution and/or price reduction.

  13. A new transparent top layer must be applied within 6 years.
